These Terms of Use (“Terms”) govern your use of genlyme.org and other websites operated by Generation Lyme, Inc. (“Generation Lyme,” “we,” “us,” or “our”) that link to these Terms (collectively, the “Site”). Certain provisions of these Terms also apply to your interactions with Generation Lyme through our official social media accounts and other digital channels, as described below.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Additional terms, Community Guidelines, releases, waivers, or agreements may apply to specific Generation Lyme programs, events, services, or activities.
About Generation Lyme
Generation Lyme is a nonprofit organization serving people affected by Lyme disease and other tick-borne diseases through community, education, resources, advocacy, and related programs.
The Site provides information about Generation Lyme, our programs and community, Lyme disease and other tick-borne diseases, and resources that may be useful to people affected by these conditions.
Informational Purposes Only
Information provided through the Site is for general informational and educational purposes only.
Generation Lyme does not provide medical, mental health, legal, financial, or other professional advice through the Site.
Nothing on the Site establishes a physician-patient, therapist-patient, attorney-client, or other professional relationship.
Information available through the Site is not intended to substitute for individualized advice, diagnosis, treatment, or other services from an appropriately qualified professional.
If you have questions about your individual health or medical care, consult an appropriate healthcare professional.
Meet-Ups and Community Programs
Generation Lyme offers Meet-Ups and other community programs for people affected by Lyme disease and other tick-borne diseases.
Generation Lyme Meet-Ups are peer community and support spaces. They are not medical care, mental health treatment, therapy, crisis services, or a substitute for professional care.
People participating in Meet-Ups or other community programs may share personal experiences, opinions, information, or resources. Statements made by community members represent their own experiences and views and should not be understood as medical or other professional advice or as statements by Generation Lyme.
Participants are responsible for deciding what personal information they choose to share in community settings.
Participation in Generation Lyme programs may be subject to separate Community Guidelines, Meet-Up Terms, releases, waivers, or other program-specific policies or agreements. If a program-specific agreement conflicts with these general Site Terms regarding participation in that program, the program-specific agreement will control.
Additional requirements or permissions may apply to participants who are minors.
Healthcare Providers, Directories, and Third-Party Resources
Generation Lyme may provide links to or information about healthcare provider directories, nonprofit organizations, financial assistance programs, social services, educational resources, research, products, services, and other third-party resources.
Generation Lyme does not independently verify every person, organization, provider, program, resource, or statement included in a third-party resource.
Unless Generation Lyme expressly states otherwise, inclusion of or reference to a third party does not constitute a recommendation, endorsement, certification, guarantee, or representation by Generation Lyme regarding that person, organization, product, service, information, or its suitability for any particular person.
You are responsible for evaluating whether a third-party provider, resource, product, service, or organization is appropriate for your circumstances.
Third-Party Websites and Services
The Site may contain links to or integrate with websites, services, directories, scheduling tools, videoconferencing platforms, donation processors, social media platforms, research publications, and other resources operated by third parties.
Generation Lyme does not control third-party services and is not responsible for their availability, accuracy, content, privacy practices, security, products, services, or conduct.
Your use of third-party services is governed by the applicable third party’s terms and policies.
Social Media and Other Digital Channels
Generation Lyme maintains accounts on third-party social media platforms and may communicate with our community through other digital channels.
Your use of a social media platform is subject to that platform’s own terms, policies, and privacy practices. Generation Lyme does not control the operation or data practices of third-party platforms.
Generation Lyme Content shared through our official social media accounts remains subject to the intellectual property, attribution, and content-use provisions of these Terms.
Comments, messages, posts, or other content shared by community members represent the views of the people who share them and do not necessarily represent the views of Generation Lyme. Information shared by community members should not be understood as medical or other professional advice.
We may moderate, hide, remove, or report content, or restrict interactions with our accounts, when we believe it violates our Community Guidelines, these Terms, applicable platform rules, or the safety and integrity of our community, subject to the tools available on each platform.
Please use care when sharing personal or health-related information on public social media platforms.
Patient Stories and Submitted Content
Your story is yours.
Generation Lyme does not claim ownership of your lived experiences, health history, identity, or personal story simply because you share them with us.
When you choose to share a story, testimonial, photograph, video, recording, written submission, or other content with Generation Lyme for publication or other use, we may ask you to enter into a separate release or permission agreement.
That agreement governs Generation Lyme’s rights to use, edit, reproduce, publish, distribute, display, promote, archive, and repurpose the specific content you provide or help us create.
Generation Lyme may create original materials incorporating content provided by contributors, including edited videos, graphics, publications, social media content, designs, compilations, and other productions. Generation Lyme may own rights in those original materials, subject to the rights of contributors and the terms of applicable releases or agreements.
If these Terms conflict with a separate written release or agreement concerning your story or submitted content, the separate agreement will control.
Generation Lyme Content and Intellectual Property
Unless otherwise indicated, text, graphics, logos, designs, photographs, videos, audio, publications, downloads, and other materials created by or for Generation Lyme and available through the Site (“Generation Lyme Content”) are owned by or licensed to Generation Lyme and may be protected by copyright, trademark, and other applicable laws.
You may access and use Generation Lyme Content for personal, informational, educational, and other lawful noncommercial purposes, subject to these Terms and any additional notices associated with particular Content.
You may link to publicly available pages on the Site and quote reasonable portions of Generation Lyme Content with clear attribution to Generation Lyme.
Except as permitted by these Terms, an applicable content license, applicable law, or written permission from Generation Lyme, you may not reproduce, republish, distribute, sell, license, modify, or commercially exploit substantial portions of Generation Lyme Content.
Nothing in these Terms is intended to restrict rights available under applicable law, including fair use.
Search Engines, Artificial Intelligence, and Automated Access
Generation Lyme supports making our publicly available information discoverable and useful to people seeking information about Lyme disease, other tick-borne diseases, Generation Lyme, and our resources.
Search engines, research and discovery tools, and artificial intelligence systems may access publicly available Site Content for purposes such as indexing, discovery, linking, summarization, and citation, subject to applicable law and any technical controls we may implement.
Permission to access publicly available Content does not, by itself, grant permission to reproduce substantial portions of the Site, republish Generation Lyme’s content at scale, create or sell a database substantially composed of Generation Lyme Content, create a substantially duplicative service, or otherwise commercially exploit Generation Lyme Content.
Automated systems may not access or use the Site in a manner that disrupts its operation or security, imposes an unreasonable burden on our systems, circumvents technical access controls, or violates applicable law.
Nothing in this section restricts uses permitted by applicable law or by a separate license or agreement with Generation Lyme.
Attribution and Generation Lyme's Identity
When you quote or reference Generation Lyme Content, attribution should identify Generation Lyme and, where practical, link to the relevant page on genlyme.org.
Generation Lyme’s name, logos, trademarks, branding, and Content may not be used in a manner that falsely suggests that Generation Lyme endorses, sponsors, partners with, or is affiliated with a person, organization, product, service, publication, or other activity.
Accuracy and Currency
Generation Lyme works to provide useful and accurate information. However, medical knowledge, scientific research, third-party resources, provider directories, financial assistance programs, services, links, schedules, and other information can change.
Generation Lyme does not guarantee that all Site Content or third-party information is complete, current, accurate, available, or appropriate for every person or circumstance.
We may correct, update, remove, or modify Site Content at any time.
Acceptable Use
You may not use the Site:
for unlawful, fraudulent, abusive, threatening, or deceptive purposes;
to interfere with the operation, availability, or security of the Site;
to attempt unauthorized access to the Site, systems, accounts, or data;
to introduce malware, malicious code, or other harmful technologies;
to impersonate another person or misrepresent your affiliation with Generation Lyme;
to collect personal information about others in violation of applicable law;
to circumvent technical restrictions or security measures;
to infringe or violate the intellectual property, privacy, publicity, or other rights of Generation Lyme or another person; or
in any manner that violates these Terms or applicable law.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and its Content are provided on an “as is” and “as available”basis.
Generation Lyme makes no warranties, express or implied, regarding the availability, operation, accuracy, completeness, reliability, security, or suitability of the Site or its Content.
Your use of the Site and reliance on information available through it are at your own discretion and risk.
Limitation of Liability
To the fullest extent permitted by applicable law, Generation Lyme and its directors, officers, employees, volunteers, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, inability to use, or reliance on the Site, its Content, or third-party resources linked from the Site.
Generation Lyme is not responsible for the acts, omissions, advice, services, products, or conduct of independent third parties referenced through the Site.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Generation Lyme and its directors, officers, employees, volunteers, agents, and affiliates from claims, liabilities, damages, losses, and reasonable costs arising from your material violation of these Terms, unlawful misuse of the Site, or infringement of the rights of another person through your use of the Site.
Privacy
Your use of the Site is also subject to Generation Lyme’s Privacy Policy, which describes how we collect, use, share, and protect information.
Changes to the Site
Generation Lyme may modify, update, suspend, discontinue, or restrict any portion of the Site or its Content at any time.
Changes to These Terms
We may update these Terms as our Site, programs, practices, or legal requirements change.
When we make changes, we will update the “Last Updated” date above. Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms or the Site will be subject to the jurisdiction of the state and federal courts having appropriate jurisdiction in New York, except where applicable law provides otherwise.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. The affected provision will be enforced to the maximum extent permitted by applicable law.
